trading Conditions

The Equipment is delivered, when the Lessor has placed it on the agreed place of delivery in well maintained and functional.condition.

In general the first period of rent - which also is the minimum period – is the remaing days of this month + the number of days in the succeeding month. In addition all charges from the depot to the place of delivery and return transport back to the depot and handling out and in charges.

Thereafter the rental will be charged monthly ahead. Unless other terms have been agreed the terms of payment are: Net cash 0 days.

After the first period of rent the Leasee can terminate the agreement with a notice of 3 days.

The Equipment to be empty and clean and be in a place enabling the Lessor to pick it up with hindrance. Otherwise the Leasee is committed to compensate the Lessor eventual extra charges.

The Leasee has the full responsibility for the Equipment and for the use of same and to pay to the Lessor all repair costs – except normal wear and tear.
The Leasee is committed to insure the Equipment against fire, theft or other damge up to the Replacement Value mentioned on The Invoice and in case of total loss to compensate the Lessor accordingly.

The Lessor has a Lien in the Equipment and the Contents according to NSAB 2000, §14.

Containerland Danmark has sold to the Buyer the Equipment as specified in the condition AS IS.

At the same time all rights and obligations are transferred to the Buyer.

The right of property, however, remains with Sellor untill full payment has been received. Terms of payment Net Cash 0 days.

As a security for the payment of all other claims the Sellor might have on the Buyer, the Sellor has a Lien in the Equipment and the Contents according to NSAB 2000, §14.

All services rendered are subject to the General Conditions of the Nordic Association of Freight Forwarders /NSAB2000). Under these conditions our liability for loss, deterioration of or damage to goods to SDR 8.33 per kilo and for delay to the amount of the freight, and for all other loss to SDR 50.000 in respect of each assignment and totally in the event of any one occurrence to SDR 500,000 (§ 24). For storage, the total liability is limited to SDR 500,000 for damage occurring in the same occasion (§ 25). Special attention is directed to the network clause (§ 2), claims against the freight forwarder are statute-barred after one year (§ 28); and the lien on goods (§ 14) applies to both current and previous claims. Claims for freight etc. must be honoured regardless of the terms of delivery under the contract of sale or freight agreement (§ 10)
